Physician to Pay $95,000 to Resolve False Claims Charges Related to Genetic Testing

NEW YORK – The US Attorney's Office for the Eastern District of Pennsylvania said Monday that a Philadelphia-area physician has agreed to pay $95,000 to resolve an allegation of False Claims Act violations stemming from the ordering of medically unnecessary genetic testing.

According to the government, between August 2018 and May 2020, Nishi Patel referred more than 400 patients for medically unnecessary genetic tests that were paid for by Medicare, with many of these tests costing thousands of dollars per patient.

The government alleges that Patel had no medical relationship with these patients and never examined these patients, and that the referrals were based on brief telemedicine consultations, and in some instances, no consultation.
